These Terms & Conditions ("Terms") govern your engagement with NEXUS ADVISING LLC ("Company," "we," "us," or "our") and your participation in our SMS messaging program. By engaging with us, providing your mobile number, or opting in to receive messages, you agree to these Terms.
1. SMS Messaging Terms
Program Description. NEXUS ADVISING LLC may send SMS notifications to team members for internal business communication purposes, along with occasional promotional messages.
How You Opt In. You consent to receive SMS messages from NEXUS ADVISING LLC when you provide your mobile number through our intake forms, employment or onboarding documentation, written agreement, or other authorized sign-up method, and affirmatively agree to receive text messages. Consent to receive marketing messages is not a condition of any purchase, employment, or service.
Message Frequency. Message frequency varies.
Costs. Message & data rates may apply. Charges are imposed by your mobile carrier and are your responsibility.
Opting Out. You may cancel SMS messages at any time. Reply STOP to any message to unsubscribe. After opting out, you will receive a one-time confirmation message, and no further messages will be sent unless you opt in again.

Carrier Disclaimer. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed.
2. Privacy and Data Use
We respect your privacy. Your mobile phone number and messaging consent information will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Information collected in connection with our SMS program is used solely to deliver messages you have requested, to comply with legal obligations, and as otherwise described in our Privacy Policy. All other categories of data are handled in accordance with our Privacy Policy.

3. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to participate in our SMS program and engage with our services. By opting in, you represent that you meet this requirement and that you are the account holder or authorized user of the mobile number provided. You agree to notify us promptly if your mobile number changes or is deactivated.
4. Acceptable Use
You agree not to use our services or messaging program for any unlawful purpose, to transmit harmful or deceptive content, or to interfere with the operation of our services. We reserve the right to terminate messaging to any number that violates these Terms.
5. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEXUS ADVISING LLC IS NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, INCLUDING SMS MESSAGING. THIS INCLUDES, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, AND DAMAGES FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
6. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Your continued engagement with us, or continued receipt of SMS messages, after changes are posted constitutes acceptance of the revised Terms.
7. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services shall be resolved in the courts located in Kane County, Illinois.
